Did Kim Ogg abuse the power of her office? Could she be indicted?

As the Houston Chronicle continues its investigation of the District Attorney’s Office, Kim Ogg, questions came to mind. If Kim Ogg used her office as a tool for personal vendettas could she be investigated by Sean Teare if he were to win the election? Could she charged for abuse of office?

Rachel Palmer Hooper’s hiring added a dose of political intrigue into a high-stakes legal showdown after she logged hundreds of hours of work that helped lead to indictments against three of County Judge Lina Hidalgo’s former staffers. Now District Attorney Kim Ogg is facing fresh criticism for hiring the state Republican Party’s general counsel to work on a politically fraught case despite having a full-time public corruption division at the time.

Revelations that Ogg hired Hooper to work behind the scenes, unbeknownst to the defense teams involved, intensified fury that the district attorney was using the case to retaliate against Hidalgo’s administration. 

Hidalgo, whose Democrat-led court has increased funding for Ogg’s office annually but denied requests for additional prosecutors, has painted the indictments as part of a political vendetta. Ogg has refuted that characterization.

Ogg offered an array of reasons for why she hired Hooper. She blamed a staffing shortage, saying that three prosecutors were on military leave, to explain the need for extra help.

But timecards obtained through records requests dispute that claim.

Kim Ogg’s report is less than thirty (30) pages, while Sean Teare’s report is close to two hundred (200) pages. Mr. Teare has quite a few ten and twenty dollars donations. Those small donations indicate that the people who vote but don’t normally give money are supporting Sean Teare. I would be surprised if Mr. Teare fails to win by at least ten percentage points.
