A group of residents in Oak Creek, Wisconsin are suing their city in an effort to block a Buc-ee’s travel center from coming to their community.
In a lawsuit filed Friday, a nonprofit known as Oak Creek Neighbors United challenges the city’s move to rezone land for a proposed Buc-ee’s, alleging the city doesn’t have the legal authority for the rezoning. The nonprofit argues the action is “illegal spot zoning,” which can involve a way of zoning that singles out a small tract surrounded by a uniformly zoned area that’s then reclassified, and keeps the small tract from having restrictions that the rest of the area is subjected to.
