Some were sentenced to anywhere from five years to 10 years. They were done in no time at all.
“Pretty much,” said Andy Kahan with Crime Stoppers. “Nobody even did half of their sentence.”
According to court documents, 53-year-old Omar Perez, a third grade teacher at the time, was charged with continuous sexual abuse of a child.
On July 6, 2023, he pled guilty to a reduced offense, indecency with a child by exposure, and sentenced to seven years’ probation.
They wrote the name wrong; the person’s name is Oscar, not Omar. That is important as a search does search video only written words so a search of Omar Perez would indicate that he had been the person in the news story.
There is much more to the case than what was presented; Fox News continues to misinform the public.
The case was filed in 2016.
Seven years after going to trial, the jury was deadlocked and could not reach a verdict.
For seven years, Perez fought the charge, and I am reasonably sure he was told that if he did not plead, the state would retry the case. If you were in his shoes, what would you do?
Perez pleaded no contest to indecency and received deferred adjudication. Kim Ogg did not prove that he was guilty; they wore the man down. The jury, indeed, did not find him guilty. So why is Fox News still going after that person and the Judge who states they reviewed all the evidence and dismissed the probation?
Deferred adjudication is a special form of judge-ordered community supervision (commonly
known as “probation”) that permits a defendant to accept responsibility for a crime without an
actual conviction being placed on the record. Only a judge can grant deferred adjudication, not
a jury, so the prosecutor and defendant must agree to waive a jury trial.
Who is eligible?
Any defendant charged with a misdemeanor crime other than driving/flying/boating
while intoxicated. In addition, any defendant charged with a felony, except:
Driving/flying/boating while intoxicated;
Intoxication assault;
Intoxication manslaughter;
A repeat drug offense enhanced with a drug-free zone finding; and
A repeat sex offense (indecency with a child, sexual assault or aggravated sexual assault)
I guess that we can expect the right-wing media to continue its war against Democrats. We don’t know the full story, but we can expect biased reporting from main news legacy media, especially anything associated with Fox.
